Procurement and Contracting

New Jersey HB1967, "An Act Concerning Public Contracting and Amending Various Parts of Statutory Law."

This bill, which became law in April 2006, authorizes the procurement of goods and services from the General Services Administration (GSA) by any contracting unit, state/community college, or board of education.

For a board of education or a contracting unit the GSA contract must be below $500,000 and the contract must not exceed the dollar amount for the same goods or services offered by a state contract.

New York HB6641 & SB5107 "An Act to Amend the General Municipal Law, in Relation to Certain Public Procurement Contracts"

This legislation would allow any general, special or local agency/board to procure goods and services from GSA or the U.S. Communities Government Purchasing Alliance. It also would implement a minimum training requirement for procurement officers.

The bill has yet to be voted on by committee, but it will carry over to the next legislative session.

Virginia HB458, the "Virginia Public Procurement Act."

This bill became law affective July, 2006. It authorizes any authority, department or institution in Virginia to purchase goods and services from other states or GSA through a cooperative purchasing agreement.

The purchase of telecommunications or IT equipment is subject to approval by the Chief Information Officer of the Commonwealth. All other purchases must be approved by the Director of the Division of Purchases and Supply of General Services.

HI HB485/SB902, "Procurement and Employment Preferences."

This legislation would establish a procurement preference/incentive for companies bidding on state and county projects to hire disabled or special assistance employees. It would set a five percent cap on the procurement preference. The bill would also require the Department of Human Services to provide a registry of disabled employees that are seeking employment.

The bill is supported by the Hawaii Department of Accounting, Hawaii Department of General Services, State Rehabilitation Council, the Workforce Development Council and the State Procurement Office. It was referred to the Assembly's Finance Committee and will be carried over to the 2008 legislative session.

Arkansas HB1024 Contractors Employing Illegal Immigrants

This legislation became law, effective July 31, 2007. It prohibits state agencies from procuring goods or services from a contractor that employs illegal immigrants. It also prohibits state agencies from renewing contracts with companies that employ illegal immigrants.

Similar legislation is also being considered by Congress.
